1. Acceptance of Terms

By accessing or using the Wheat Flour Bakes website, mobile application, or any of our services (collectively, the "Services"), you agree to be bound by these Terms of Service and our Privacy Policy. These terms apply to all visitors, users, and customers of our Services.

2. Use of Our Services

Eligibility

You must be at least 19 years old (the age of majority in British Columbia) to use our Services. By using our Services, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.

Account Registration

To access certain features, you may need to create an account. You agree to:

Maintain and promptly update your account information
Maintain the security of your password and account
Accept responsibility for all activities under your account

Product Descriptions

We strive to provide accurate descriptions and images of our products. However, we do not warrant that product descriptions, images, or other content is accurate, complete, reliable, current, or error-free. Products may vary slightly from their images.

Availability

All products are subject to availability. We reserve the right to discontinue any product at any time without notice. We may limit the quantities of products available for purchase.

Pricing

Prices for our products are subject to change without notice. We reserve the right to modify or discontinue any product without notice. We shall not be liable to you or any third party for any modification, price change, suspension, or discontinuance.

4. Orders, Payment and Taxes

Order Acceptance

We reserve the right to refuse or cancel any order for any reason, including but not limited to:

Product or service availability
Errors in product or pricing information
Errors in your order
Suspected fraudulent activity

Payment Processing

All payments are processed securely through Stripe. By providing payment information, you represent that you are authorized to use the payment method. You agree to pay all charges at the prices then in effect, including shipping and handling charges.

Canadian Taxes

All prices are in Canadian dollars (CAD) unless otherwise specified. Applicable taxes will be calculated based on your location:

British Columbia residents: GST (5%) + PST (7%)
Other Canadian provinces: GST/HST as applicable
International orders: No Canadian taxes applied

Business customers with valid GST/HST numbers may be eligible for tax exemptions.

Billing Errors

If you believe there is an error in your billing, please contact us immediately at [email protected]. We will investigate and respond to your inquiry promptly.

5. Subscriptions

Some parts of our Services are billed on a subscription basis. You will be billed in advance on a recurring and periodic basis (weekly, monthly, or annual).

Automatic Renewal

Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period.

Cancellation

You may cancel your subscription at any time through your account settings. Cancellation will take effect at the end of the current billing period. We do not provide refunds for partial subscription periods.

Fee Changes

We may change subscription fees upon 30 days' notice. Such notice may be provided via email to the address associated with your account.

6. Shipping and Delivery

We offer shipping throughout Canada and select international destinations. Delivery times vary:

Greater Vancouver Area: 1-2 business days
British Columbia: 2-3 business days
Rest of Canada: 3-7 business days
International: 7-14 business days

For perishable goods, we recommend expedited shipping. We are not responsible for spoilage due to shipping delays beyond our control. Risk of loss and title pass to you upon delivery to the carrier.

7. Returns and Refunds

Our return and refund policy:

Non-perishable items may be returned within 30 days of delivery
Items must be unused and in original packaging
Perishable goods cannot be returned for food safety reasons
Custom or personalized items are non-refundable
Shipping costs are non-refundable
Refunds will be processed to the original payment method

8. Intellectual Property

All content on our Services, including text, graphics, logos, images, audio clips, digital downloads, and software, is the property of Wheat Flour Bakes or its content suppliers and is protected by copyright and other intellectual property laws.

Limited License

We grant you a limited, non-exclusive, non-transferable license to access and use our Services for personal, non-commercial purposes. This license does not include any right to:

Resell or make commercial use of our Services or content
Modify or make derivative works based on our content
Download or copy account information for another's benefit
Use data mining, robots, or similar data gathering tools

9. User Content

By submitting content to our Services (reviews, comments, photos), you grant us a non-exclusive, worldwide, royalty-free, perpetual, irrevocable license to use, reproduce, modify, adapt, publish, and display such content.

You represent and warrant that you own or control all rights to the content you submit and that your content does not violate these Terms or any applicable laws.

10. Disclaimers and Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE"

We make no warranties, express or implied, regarding the Services, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance.

We do not warrant that the Services will be uninterrupted, timely, secure, or error-free, or that defects will be corrected. We make no warranty regarding the quality, accuracy, timeliness, truthfulness, completeness, or reliability of any information or content.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

Wheat Flour Bakes, its affiliates, directors, employees, agents, and suppliers shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, use, goodwill, or other intangible losses resulting from your use of our Services.

Our total liability shall not exceed the amount paid by you to us in the twelve months preceding the claim.

12. Indemnification

You agree to indemnify, defend, and hold harmless Wheat Flour Bakes and its affiliates, directors, officers, employees, and agents from any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or related to your use of the Services, violation of these Terms, or violation of any rights of another.

13. Dispute Resolution

Informal Resolution

Before filing a claim, we encourage you to contact us at [email protected] to attempt to resolve any dispute informally.

Arbitration

Any dispute not resolved informally may be resolved through arbitration in accordance with the Arbitration Act of British Columbia. Arbitration shall be conducted in Vancouver, BC, and judgment may be entered in any court of competent jurisdiction.

Class Action Waiver

You agree to resolve disputes only on an individual basis and not as part of any class, consolidated, or representative action.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Province of British Columbia and the federal laws of Canada applicable therein, without regard to conflict of law provisions. You consent to the exclusive jurisdiction of the courts located in Vancouver, British Columbia.

15. Changes to Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by email or by posting a notice on our Services. Your continued use of the Services after such modifications constitutes acceptance of the updated Terms.

16. Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be replaced with a valid provision that comes closest to the intent of the original.

17. Language

These Terms of Service are available in English. Where required by law in Quebec, French language versions can be provided upon request.

18. Entire Agreement

These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and Wheat Flour Bakes regarding the use of our Services and supersede all prior agreements and understandings.
